Subject: Tango copyright
Dear friends from tango list
I would like to comment that argentine law 11.723 of intellectual property have gone through several amendments . Two of this amendments are interesting to comment
1) the copyright ends now, 70 years after the 1st of january of the following year of the death of the author, being the copyright collectable by their family .
For example "Danzarin" from Julian Plaza will cease copyright as from January 1st 2074, since Julian Plaza passed away.
Existing tango recordings excluded would be those from authors died on year 1932 , for this year 2003 , and it seems there are not too much inm taht condition
2) MP3 files are considered phonograms , therefore the use of this files also have to pay copyright . There is already a local case of a commercial company that decided to dismantle their internet Mp3 facility ( MPTrez) , since a legal action and SADAIC (local society of authors and composers) concluded that the company was giving for free Mp3 files taken from an external database recording and not provided by the person that asked for an MP3 file copy . The trick was that the argentine company offer their service as a copy service from originals supplied by the subscriber . The real fact was that with "hook" , it made an own database and then provide multicopies to several users, which is what the copyright law intend to protect
warm regards
